Terms of Service

These Terms of Service (“Terms”) govern your use of BabyPenguin’s website and mobile apps (together, the “Service”), operated by BabyPenguin. By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

You must be at least 18 years old (or the age of legal majority where you live) and able to form a binding contract to create an account. BabyPenguin is a tool for parents, co-parents, and caregivers to track information about a baby or expected baby in their care — it is not intended for use by children.

You’re responsible for the accuracy of what you enter and for keeping your login credentials secure. Inviting a co-parent or babysitter gives them access to log and view the baby’s information you’ve shared with them, as described in our Privacy Policy.

BabyPenguin is a personal record-keeping tool, not a medical device or a source of medical advice. Growth charts, fever/temperature tracking, medication reminders, vaccine schedules, and any AI-generated insights are provided for convenience and general informational purposes only. They are not a substitute for professional medical judgment. Always consult your pediatrician or another qualified healthcare provider with any questions about your child’s health, growth, medications, or vaccination schedule — including in urgent or emergency situations, where you should contact emergency services directly rather than relying on the app.

BabyPenguin offers a free plan and an optional paid Premium plan with additional features. If you subscribe to Premium:

• The price and billing period are shown to you before you confirm your purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal.
• Purchases made through the web are billed and managed via Stripe, from your account’s billing settings.
• Purchases made through the iOS app are billed by Apple through your App Store account. Manage or cancel them in your device’s Settings → [your name] → Subscriptions, in accordance with Apple’s terms. Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.
• We don’t offer refunds directly for App Store purchases — those are handled by Apple per their own policies.

You agree not to:

• Use the Service for anything illegal, or to store information about a child you don’t have the right or responsibility to care for.
• Attempt to access another family’s data without authorization.
• Reverse-engineer, scrape, or interfere with the Service’s normal operation.

BabyPenguin and its branding, design, and code are owned by us. The content you enter (your family’s logs, photos, and notes) belongs to you — we only use it to provide the Service back to you, as described in our Privacy Policy.

You can delete your account at any time from within the app. We may suspend or terminate accounts that violate these Terms.

The Service is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, BabyPenguin isn’t liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on any tracked data or AI-generated content.

We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date above and, where appropriate, notify you in the app.
